STATEMENT TO CUSTOMERS

Thank You for your interest in our products. We use a variety of companies, with our manufactured parts, to give you the best price possible. We have tested or built most of our parts to make sure you are getting the quality, with the price. Our company strives to make internet, phone, and personal transactions as easy as possible. That is why we have a liberal policy on our warranties, exchanges, and returns. We provide a safe way to purchase for our customers and that is why we have posted our Warranties and Policies on our website, to protect you as the customer, and us as the seller.

POLICIES

GENERAL

Please read all information below before purchasing with SMW, Inc. These terms govern all of our sales, and are not to be changed except with our written permission. These terms are to be interpreted to Oklahoma Law. Your placing an order, whether signed or unsigned, will constitute acceptance of our policies and guarantee of payment.

TERMS

All prices are listed from SMW, Inc. in Ardmore, OK. These prices are subject to change at any time, without notice. All duties, taxes, and transportation costs are extra when applicable. We also reserve the right to make substitutions, and without prior notice to discontinue at any time, at our discretion, any parts or accessories depicted on our website, or to change policies, prices, specifications or designs without incurring any obligation to the customer. All products are subject to availability. The website content linked to, and displayed on our SMW, Inc. website, is owned, copyrighted and maintained by SMW, Inc. or the respective manufacturer and/or distributor. Every effort is taken to have correct and accurate information on our website, we have no control over this content and therefore it is agreed to, we will not be held liable for any information, illustration, wording, digital image that is in error on our part or others. We have the right to correct information, prior to or after, a transaction is made.

ORDERING

All of our products made or distributed by us may not be legal in your state or country. Please check with your state for legality before ordering. ALL PRODUCTS SOLD BY SMW, INC. OR ANY OF ITS EMPLOYEES, MUST BE ASSEMBLED BY A QUALIFIED AND CERTIFIED MOTORCYCLE MECHANIC. WE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE OR INJURY, FOR ANY PARTS ALTERED AND ASSEMBLED BY ANY OTHER PERSON. ALTERING OF PARTS MAY CAUSE FAILURE OR DAMAGE THAT CAN CAUSE INJURY OR DEATH. When placing an order by phone, please be as specific as possible to any references to our website. We are not responsible for description errors.

PAYMENT

Due to the increasing amount of credit card fraud, we at SMW, Inc. will require additional information from the purchaser. All personal information is held to strict confidentiality.
OUT OF STOCK & BACK ORDERS

Although we make every effort to not be out of stock, we do occasionally rely on other suppliers for parts and some things are out of our control. From time to time, we do have back orders. We fill our back orders as quickly as possible. However unlikely, an order might be delayed due to a back order. After 30 days, the backorder will be cancelled, and a credit will be issued or an alternative part might be shipped with customer approval.

SHIPPING

Shipping charges vary from order to order. Shipping rates depend on size, weight, location, and carrier. We will give you a quote before you order; however, we reserve the right to change any charges. All shipping quotes are given based on information provided by the customer. If any information is incorrect, and additional freight charges are applied by the carrier, the customer is responsible for those charges. All quotes include handling and insurance. All international shipping charges, including fees, insurance, taxes, duties, are handled by the customer. If the shipment is returned by their customs agent in their particular country, because of laws prohibiting items shipped, documentation, or other legal circumstances, the incurring charges, thereafter, are the responsiblity of the customer. We are by no means responsible for any laws or changes to the law, prohibiting any items we sell, by that country. We only assume the customer has checked with his country's law or import laws on any order being received from SMW, Inc. Any shipping times given by SMW, Inc. are only approximates. Any delays due to back orders or part supply are out of our control. We will make every attempt to send the order on time, with no back orders.

DAMAGED OR LOST IN SHIPMENT

All damaged or lost parts must be reported to us within 10 days. Original packaging must be kept for investigative reasons by the carrier. We will replace the part, if it has been verified that the item or items have been lost (except international orders). If the part is damaged due to shipping, the part must be first inspected and a completed investigation by the carrier, before it’s returned and replaced. There are some exceptions, so call us if you have a damaged part for quick replacement.

RETURNS & EXCHANGES

We want you to be completely satisfied with your purchase. We offer a return policy for 30 days. If you are not satisfied with the part for any reason, just simply return it for an exchange or refund. It is only part exchanges for bike kits, drivelines, and engine purchases. Rules and regulations apply, so please read the following before purchasing with SMW, Inc.

Items must be well packed or they will not be accepted. Refunds or exchanges will only be given upon inspection of the part by SMW, Inc. Any altering or changing of the part may not be accepted. Defective merchandise will be exchanged for same part only. Exchanges are made depending on availability of alternative part. A note must be with the part with the following information

Name and Address / Reason for Return / Exchange or refund

Due to the inherent nature of some products, the following items cannot be returned or exchanged under any circumstances:
Alternator rotors, wiring harnesses, manuals.

CREDIT CARD REFUNDS

All refunds with a credit card purchase will be credited to the credit card used. Because of policies, some issuing banks impose on refunds credited back to your credit card; please allow 1-2 billing cycles or up to 30 days for the refund credit to appear on your written statement. Check with your issuing bank.

ENGINE WARRANTY AND PROCEDURES

This section is intended for warranties on motors sold by SMW, Inc. ALL MOTORS THAT ARE SOLD FROM SMW, INC. ARE PRE-RUN AND TESTED BY SMW, INC. BEFORE SHIPPING. THIS INSURES THE QUALITY OF THE MOTOR. MOST MANUFACTURERS DO NOT PRE-RUN THEIR MOTORS BECAUSE OF PRODUCTION REASONS. This warranty is for the motor only, and does not include charging systems or carburetor. All 100” through 127” displacement engine components and parts are guaranteed by the manufacturer, to the original purchaser, to be free of defects in materials and workmanship for a period of 36 months. SMW, Inc. must be notified as soon as the problem or warranty issue arises.
However unlikely, in the event a warranty issue arises, SMW, Inc. must be notified about the problem. Most issues can be handled by phone and need no further course of action. A part being suspected must not be replaced by dealer without authorization from SMW, Inc. Because all motors are assembled by SMW, Inc., Ultima, S&S, or Rev Tech, serial numbers and a copy of the invoice might be requested from the original purchaser. If the part needs to be replaced, the part must be returned to SMW, Inc. to determine whether the part was defective. Upon our discretion, we will replace the part to have it reinstalled by a qualified mechanic. If the problem occurs more than once, the motor must be returned to us for evaluation. The purchaser can take his/her motor into a certified and qualified motorcycle mechanic that is an authorized dealer for that particular motor. The dealer must be in good standing with SMW, Inc., Ultima, S&S, or Rev Tech. Labor and cost issues will be handled by SMW, Inc. Up to $245.00, depending on the service performed, in labor cost will be reimbursed to the customer for any parts being replaced by the authorized dealer. For us to reimburse any purchaser the following must be met. 1) Must be paid to the original purchaser of the motor. 2) The parts being serviced on the motor must be returned from the authorized dealers business address. 3) The dealer must be a qualified and certified motorcycle mechanic that is in good standing with the motor's manufacturer. 4) The dealer must send a letterhead invoice of the service performed and the amount. He/she must include their dealer number for that particular motor manufacturer and fax to 309.276.0454. For any repairs of $246.00 in service or more, the motor must be sent back to SMW, Inc. for repair. SMW, Inc. will pay for shipping to the the purchaser’s location depending on the nature of the return (excluding international shipments) thru our designated carrier. The motor must be properly packed to insure no further damage from the purchaser. The purchaser is responsible for removing the motor if installed, packaging the motor, and returning the motor undamaged to SMW, Inc. Any damage incurred will be the responsibility of the sender/purchaser. Once the motor arrives safely, we will inspect it and make necessary repairs or replace the motor per our discretion. Additional Warranty provisions: 1) SMW, Inc. shall have no obligation in the event the motor has been modified by any other person or organization. 2) SMW, Inc. shall have no obligation in the event the motor or part has become defective in whole or part as a result of improper installation, improper maintenance, improper use, or any other neglectful use of the motor. 3) SMW, Inc. shall not be liable for any consequential or incidental damage resulting from the failure of a part sold by SMW, Inc., the breach of any warranties, the failure to deliver, delay in delivery, delivery in non-conforming condition, or for any other breach of contract or duty between SMW, Inc. and purchaser. All motors we sell are designed to fit in Harley Davidson type motorcycles and we will not be responsible if installed in anything other. The purchaser should follow all documentation provided with the motor unless it conflicts with the above warranty statement.

90 DAY "BUILDER'S WARRANTY"

For any motor purchased after January 1, 2010, we now offer a 90 day additional warranty. The warranty length is 3 years and 90 days. We do this because most customers will not run their motors when they receive them, and we are confident you are getting a good motor. Because we pre-run and test all our motors, we are able to judge the quality of motor and send you a motor that we know will last. This warranty is an additional 90 days to the above policy. It is only applicable to the original purchaser.

OTHER WARRANTIES & PROVISIONS

SMW, Inc. uses different transmission manufacturers for different applications. All transmissions we sell have at least a 2 year manufacturer’s warranty. All transmission warranties are replacement warranties (i.e., Send the transmission in for a new one). Therefore, all transmission warranty claims will be handled through that particular manufacturer. However, SMW, Inc. does make sure the transmissions received and sold are of good quality, free of defects in material and workmanship for a period of at least 24 months from date of purchase. Manufacturer’s Warranty Cards must be filled out to claim your warranty, if it arises. SMW, Inc. is under no obligation, if purchaser does not follow these instructions or instructions on the warranty card. Purchaser also must notify SMW, Inc. if they have lost or did not receive a warranty card. All claims are between the manufacturer and the purchaser with an SMW, Inc. invoice. However, SMW, Inc. will provide any assistance between the manufacturer and purchaser. Any claims on parts where the transmission does not need to be returned, purchaser will call SMW, Inc. for replacement parts. SWM, Inc. does make sure the purchaser does get a good quality transmission from a creditable and qualified manufacturer with manufacturer’s statement of origin. All frames are guaranteed free of defects in material and workmanship when purchaser receives the frame for up to 90 days. It is up to purchaser to check the frame to ensure it is free of defects and to dry fit any parts to the frame. SMW, Inc. is no longer under obligation once the frame has been altered or painted. SWM, Inc. is also free of liability if the frame is used under any other condition, other than street use. SMW, Inc. is also not liable for any neglect or accidents with the frame. SWM, Inc. does make sure the purchaser does get a good quality frame from a creditable and qualified manufacturer with manufacturer’s statement of origin. All other parts sold from SMW, Inc. fall under return policies with SMW, Inc.
